3. How Velvet Magic works

Velvet Magic analyzes your text descriptions (typed or dictated) to recommend makeup shades suited to your skin type.

Local processing

• •Face detection is performed locally on your device (Google ML Kit).
• •Virtual makeup application is computed locally.
• •Your photos never leave your device.

Remote processing

• •Only your text descriptions are sent to our secure servers to obtain shade recommendations.
• •Voice recordings are transcribed then deleted immediately.

Important

• •All transmissions are encrypted (HTTPS/TLS).
• •No photo is sent to our servers.
• •No biometric data is extracted or retained.

4. Local storage

Your data stays on your device

• •Original and processed photos are stored locally.
• •No automatic cloud synchronization.
• •You keep full control over your images.

Deletion

• •You can delete your projects at any time.
• •Uninstalling the app removes all local data.

5. Data sharing

We NEVER sell your data.

Your information may be shared only:

• •With our servers to process Velvet Magic requests (text only).
• •If required by law (court order).

Sharing your creations on social media is a voluntary action on your part.

6. Biometric data

Important clause for compliance (BIPA, GDPR): the App analyzes your facial features (position of eyes, lips, etc.) only to apply virtual makeup.

• •No biometric data is stored.
• •No facial identification is performed.
• •This data is never shared with third parties.
• •No biometric profile is created.

7. Security

We implement security measures to protect your data:

No system is infallible. We encourage you to protect your device with a passcode.

1. Legal information and scope

The Velvet: AI Makeup Editor application (the “App”) is published by mcsÉdition, a company registered in Quebec, Canada (the “Publisher”). By downloading or using the App, you agree to be bound by these terms of use (the “Terms”). These Terms apply to all users, regardless of their country of residence (North America, Europe, Africa, Asia, Oceania).

2. Service and features

Velvet is a virtual makeup simulation application offering:

• •Preset looks : 6 ready-to-use makeup styles (Clean Girl, Parisian Chic, Latte Glam, Office Siren, Midnight Diva, Strawberry Girl).
• •Manual makeup : shade selection by category (lips, complexion, eyelids, blush) with skin-type filters.
• •Velvet Magic : a smart assistant that lets you describe the look you want by text or voice dictation to get personalized shade recommendations.
• •Ambiance : a lighting simulator to test your look under different conditions (Day, Dinner, Office, Club, Golden, Cool).

Nature of the result

The user acknowledges that the renders are artistic simulations. The Publisher does not guarantee absolute fidelity of the results compared to real makeup.

Data processing

For Velvet Magic, your text requests are sent to secure servers. By using the app, you consent to this transfer, which is necessary to deliver the service.

3. Subscriptions and payments

• •Subscription model : the App offers subscriptions (weekly, monthly, annual) and a lifetime purchase option to access premium features.
• •Free trial : some subscriptions include a free trial period. You can cancel at any time before the end of the trial without being charged.
• •In-app purchases : transactions are managed exclusively by third-party platforms (Apple App Store or Google Play Store).
• •Automatic renewal : subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• •Refunds : any payment dispute must be handled directly with Apple or Google.
• •Right of withdrawal (EU/UK) : if you reside in the European Union, you expressly waive your 14-day right of withdrawal upon immediate access to the digital content.

4. Intellectual property and content

Your photos

You retain all intellectual property rights to your original photos. You grant mcsÉdition a worldwide, non-exclusive, royalty-free license, solely for the time needed to process and generate the image (ephemeral processing).

App license

mcsÉdition grants you a personal, non-transferable license to use the App for private or professional purposes (makeup). Reverse-engineering or copying the source code is prohibited.

5. Conduct rules (safety)

It is strictly prohibited to use Velvet to:

• •Use photos of people without their explicit consent.
• •Use the application for harassment or deception.
• •Attempt to bypass Velvet Magic's safety filters.

6. Limitation of liability

• •Availability : the Publisher does not guarantee that the service will be uninterrupted or error-free.
• •Damages : to the extent permitted by local law, mcsÉdition cannot be held liable for indirect damages, data loss, or financial loss related to the use of the App.
• •Cap (global) : mcsÉdition's total liability to you is limited to the amount you paid for the App over the last 3 months.

Your privacy is protected in accordance with our privacy policy.

• •Europe (GDPR) : you have the right to access, rectify, and erase your data.
• •USA (CCPA) and Canada : you have similar rights regarding your personal information.

8. Governing law and jurisdiction

General principle

These Terms are governed by the laws of the province of Quebec, Canada. Any dispute will be submitted to the competent courts of the district of Montreal or Saint-Hyacinthe.

Consumer exception (EU/international)

If you are a consumer residing in the European Union or another jurisdiction with mandatory consumer protection laws, the provisions of these Terms do not deprive you of the protection offered by those mandatory local laws.
